DUI Suspensions and Requirements

DUI and DWI refer to driving under the influence of alcohol or another substance that can impair driving ability. This may include illegal drugs, prescription medication, over-the-counter medication, or inhalants.

As of July 1, 2020, the Kentucky Transportation Cabinet administers a fixed suspension period based on the type of conviction.

Suspensions and Penalties

Kentucky DUI suspension periods are based on the offense. After serving a required portion of the suspension, eligible drivers may apply for an ignition interlock license.

Offense Without IID With IID suspension times can be reduced to:

Approved ATC Programs
  • The Division of Driver Licensing only accepts completions from programs authorized for DUI treatment.

Kentucky Ignition Interlock Program (KIIP)

The Kentucky Ignition Interlock Program allows eligible drivers to reduce their license suspension period by driving with an approved ignition interlock device.

The program is compliance-based, and participants must remain violation-free for 90 or 120 consecutive days, based on their offense.

About KIIP

An Ignition Interlock Device (IID) connects a vehicle or motorcycle's ignition system to a breath alcohol analyzer. The device prevents the vehicle from starting if the driver’s breath alcohol concentration is over 0.02.

  • Drivers apply directly to KYTC using the Ignition Interlock Application, TC 94-175.
  • KYTC is the monitoring authority for program participants.
  • The program is available to DUI offenders who meet program requirements.
  • To qualify for a possible reduction in suspension time, participants must follow all program requirements and maintain 90 to 120 consecutive days of sober driving during their incentive period.

Wait for KYTC to receive the court action

The court will report the conviction or suspension to KYTC. This may take a few days. A withdrawal or suspension letter will be sent.

Submit your IID application and documents

You may email the documents to KIIP@ky.gov, upload them through your verified myDrive account (in-state drivers only), or submit them at any Driver Licensing Regional Office.

  • Ignition Interlock Application — TC 94-175
  • Proof of valid vehicle registration. Out-of-state drivers must provide valid registration from their state.
  • If the registration is not in the driver’s name, provide a notarized letter from the owner granting permission to install the device. The letter must include a vehicle description and VIN.
  • Proof of insurance. Out-of-state drivers must provide proof of insurance from their state.
  • $40 reinstatement fee, payable at a Driver Licensing Regional Office.

Receive your approval decision

If approved, you will receive a Letter of Approval by mail or email.

Ignition Interlock Installation

Take your Letter of Approval to a Vendor/Ignition Interlock Provider to schedule an installation appointment.

  • A list of Kentucky-approved vendors is located at the bottom of this page, or you may call 502-564-1257 for further assistance
  • The device must be installed in Kentucky unless preauthorized by KYTC.

The Service Center will provide a Certificate of Installation once the device has been successfully installed.

Visit a Regional Office

  • ​Take your Certificate of Installation to any Regional office to have a Restricted License issued.
  • The cost of the license will depend on the type of license issued.
  • Credit for participation in KIIP will only begin at the time of issuance.

Ignition Interlock Device Removal

​Upon completion of the required compliance period, KYTC will mail or email a Letter of Removal to schedule the device's removal. The Service Center will provide you with a Certificate of Removal.

​Take your Certificate of Removal to a Regional Office to have a Non-Restricted License issued. ​The cost of the license will depend on the type of license issued.

Vehicle switch

Email the following documents to KIIP@ky.gov or visit a Regional Office

  • Completed TC 94-204 Form
  • Unexpired vehicle registration
  • Unexpired proof of insurance
  • Notarized statement if the vehicle is not registered in your name

Approval letter from KYTC must be received before switching vehicles.

Vendor Switch
  • To switch vendors for the same approved vehicle, submit a completed TC 94-204 Form
  • No additional documents are required if the switch is for the same vehicle.
  • Email the form to KIIP@ky.gov or visit a Regional Office

KIIP Violations

To qualify for a possible reduction of suspension time, participants must be violation-free for 90 or 120 consecutive days, based on their offense. Violating one (or more) of the following violations will result in the consecutive counting of days to start over.

  • Failure to take any random breath alcohol test unless a digital image review confirms that a driver did not occupy the motor vehicle or motorcycle at the time of the missed test.
  • Failure to pass any random retest with a breath alcohol level of 0.02 or lower unless a subsequent test performed within 10 minutes registers a breath alcohol concentration lower than 0.02 and the digital image confirms the same person provided both samples.
  • Failure of the person or their designee to appear at the ignition interlock device provider when required for maintenance, repair, calibration, monitoring, inspection, or replacement of the device.
  • Failure to pay statutorily required fees (KRS 89A.340.).
  • Tampering with an installed ignition interlock device with the intent of rendering it defective.
  • Altering, concealing, hiding, or attempting to alter, conceal, or hide the person's identity from the ignition interlock device's camera while providing a breath sample.
Tennessee IID Waiver

When a driver resides in Kentucky but has the ignition interlock device as a reinstatement requirement in Tennessee, the Tennessee Department of Safety offers a waiver for the driver. When this occurs, KYTC can sign for TN to waive the TN IID requirement. If KYTC does not agree to sign the waiver, the driver must comply with the reinstatement requirement before the hold will be lifted in TN.

TN judges are aware that the Department offers a waiver when the driver meets specific criteria, as the TN statute specifies. Tennessee imposes both a one-year hard suspension (365 consecutive days) and a one-year IID requirement; the waiver only waives the one-year IID requirement.

If a driver has a Tennessee waiver, they will need to visit a Regional Office to:

  • Have their signature notarized on the official waiver form issued by Tennessee
  • Apply for Kentucky Ignition Interlock Program (KIIP); and
  • Provide proof of KY insurance, registration, authorization to install the IID device, make, model, and VIN of the vehicle.

Am I eligible for an Ignition Interlock Device?

Eligibility is based on activity in your five (5) year driver history record. You may not be eligible for an Ignition Interlock license if any convictions appear on your driver history record pursuant to KRS 186.560.

You may be rendered ineligible for an Ignition Interlock license or subject to revocation of an existing Ignition Interlock License pursuant to a violation of KRS 186.570.

What fees are associated with obtaining and using an Ignition Interlock device?

Device and service fees are paid directly to the device or service provider in accordance with a contract between the device provider and user of the device. Costs may include, but are not limited to:

  • Initial device installation fee
  • Monthly monitoring and calibration fee
  • Device removal fee
  • $40.00 reinstatement fee
  • Cost of issuing a new credential
Do I have to install a device on every vehicle I own?

You are only required to install a device on your primary vehicle; however, you may choose to install devices on additional vehicles. The holder of an Ignition Interlock License is only authorized to drive a vehicle with an ignition interlock device installed.

Can other individuals drive a vehicle with an ignition interlock device installed?

Yes. Anyone can operate a motor vehicle with an Ignition Interlock device installed so long as they comply with the device requirements.

Am I eligible for an Ignition Interlock License if I have a CDL?

CDL license holders must comply with federally mandated hard suspension periods for operating with a CDL under the influence of alcohol.

What if I have an emergency and my interlock device prevents me from starting my vehicle?

You should never operate a motor vehicle while under the influence of alcohol. In case of an emergency, call 911.

What if I can't afford an Ignition Interlock Device?

You may complete the KIIP Affordability Application TC 94-188. Include federal tax returns and/or paychecks, W-2, or 1099.

How do I transfer my out-of-state Ignition Interlock Device (IID) to Kentucky?
