What is the Medical Review Board?
The Medical Review Board reviews cases involving applicants or licensees whose physical or mental condition may affect or limit their ability to safely operate a motor vehicle.
The Medical Review Board consists of medical professionals appointed by the Secretary of the Transportation Cabinet. Board members review cases and provide medical advice to the Division of Driver Licensing.
Seizures, Blackouts, and Loss of Consciousness
Under
KRS 186.411 and
601 KAR 13:100, a person with a seizure condition must be free of seizures for 90 days to obtain or maintain driving privileges.
A Medical Review Board case may also be initiated when a person indicates they blacked out, lost consciousness, or suffered a seizure prior to a reportable motor vehicle accident.
A person who has experienced a seizure, blackout, loss of consciousness, or altered state of awareness, or who has experienced one of these conditions prior to a reportable motor vehicle accident, may be reported to the Medical Review Board by submitting an affidavit to the Medical Review Board.
Vision Requirements
A person must have:
• Visual acuity of 20/60, best corrected, or better in at least one eye.
• A horizontal field of vision of at least 35 degrees to the left and right side of fixation in the better eye, without interruption.
• A vertical field of vision of at least 25 degrees above and below fixation in the better eye, without interruption.
A person must meet both the visual acuity and visual field requirements to be eligible for an operator's license.
Reporting a Driver
A driver may be reported to the Medical Review Board when there is reason to believe a physical or mental condition may affect the driver's ability to safely operate a motor vehicle. A driver may be reported for conditions or circumstances that may affect their ability to drive safely, including seizures, blackouts, loss of consciousness, or other physical or mental conditions.
What Happens After a Driver Is Reported?
After a Medical Review Board case is created, the individual will be notified and sent the appropriate medical forms.
The individual must have the forms completed by their treating physician and return the requested information to the Medical Review Board.
Once the required information is received, the Medical Review Board will review the information and notify the individual of the Board's decision by mail.
